Account Registration With Molekule 
If you want to purchase el Products and use certain características of el Services, you’ll have to create an account (“Account”) with us subject to estos Terms. If you no longer want to participate in el Molekule Inner Circle Programaaa, please contact customer soporte at (855) 999-9069 for assistance in terminating your Molekule Inner Circle Programaaa membership. When you access el Site, create your Account, or purchase Product, you also have el additional opportunity to sign up to receive marketing correo electrónicos from us. Online Product Orders and Use of Third-Party Payment Vendors

Order Acceptance and Cancellation 
We reserve el right, at our sole discretion, to refuse or cancel, in whole or in part, any Product order for any reason. Molekule Proprietary Filters, Automatic Refills, and Account Portal  
Our Products differ from traditional portable indoors in el market. We use a proprietary photoelectrochemical oxidation (“PECO”) coating on our filter media que activates when exposed to el UV light source in our Products para destruir bacteriassss, virus, y compuestos orgánicos volátiles en el aire. We offer one-time Filter purchases on our Site. We also can sell Filters to you on an automatic recurring subscription basis que requires payment from you prior to shipping (a “Filter Subscription”). Different Filter Subscription plans or options are subject to different pricing and características and are available to you at eielr el time you first purchase Products or elreafter on el Site.  
 
If you sign up for a Filter Subscription, you acknowledge que your Filter Subscription has recurring payment características and you accept responsibility for all recurring payment obligations incurred prior to timely cancellation of such subscription. We (or our third-party payment processors) will automatically charge you at el time of each Filter Subscription renewal using el payment method you have provided. Upon successful Filter Subscription payment, your Filter Subscription is automatically renewed and your Filters are shipped to you. If, however, your payment method for your Filter Subscription is declined, eln your Filter Subscription will not be automatically renewed until such subscription account has been updated with a valid payment method que permits successful payment processing del filtro Subscription amount eln due. We reserve el right to change our pricing and renewal notifications for your Filter Subscription. Ownership of el Services 
All contents of el Services, incluyendo without limitation, el text, graphics, images, music, software, code, near field communication (“NFC”) tag auelntication data, data, auelntication keys, security características, unique identifier numbers, network communications, audio, video, works of authorship of any kind, and information or oelr materials que are posted, generated, provided in or on, or oelrwise made available on or through el Services, are colectivamente referred to as “Content”. el Services, incluyendo el Content, and all associated intellectual property rights elreto, are el sole and exclusive property of Molekule and/or its licensors, and may not, in whole or in part, be copied, distributed, modified, cloned, decompiled, captured, tracked, hijacked, reversed engineered, reproduced, published, bypassed, recoded, reformatted, or duplicated, except for el limited purposes expressly authorized or approved by Molekule in writing. Third-Party Services 
Molekule’s Services rely on or use third-party products and services, el operation and functioning of which are beyond Molekule’s control and are provided on an “AS IS” and “AS AVAILABLE” basis. Molekule also uses third-party products and services to enable some aspects of el Services, incluyendo, but not limited to, push notifications, outdoor air quality, and características management. el up-time and reliability of such third-party products and services can adversely impact your use and reliability of el Services. You agree que your use and availability of el Services is (i) dependent on such third-party products and services, and (ii) que such third-party products and services may not operate in a reliable manner 100% of el time, which may impact how you use el Services. usando el Services you acknowledge and agree que Molekule is not responsible to you for any damages and losses arising out of or from el operation or non-operation of any third-party products and services relied on or used by Molekule in connection with el Services. 
 
Rights in App Granted by Molekule 
Apps may be made available for your use in conjunction with el Products through third-party providers such as el Apple App Store or el Google Play Store. Such third-party apps are subject to such app provider’s terms and conditions, which can be eliminard, discontinued, terminated, suspended, and/or modified at any time for any reason.  
 
Además to such third-party app provider’s terms and conditions, your use of Molekule’s Apps is subject to your compliance with estos Terms. Molekule grants you a limited, non-exclusive, non-transferable, revocable, non-sublicensable, privilege to download and install a copy of el App on a mobile device que you own or control and to run such copy of el App solely for your own personal non-commercial purposes of using your Product in connection with el Services. This privilege terminates automatically if you breach any of el Terms.  Upon termination you must immediately cease using el App and eliminar and/or delete el App from your devices. Except as expressly permitted in estos Terms, or to el extent que any of el proceeding restrictions are prohibited by applicable law, you may not: (i) copy, modify, or create derivative works based on el App; (ii) distribute, transfer, sublicense, lease, lend, or rent el App to any third party; (iii) reverse engineer, decompile, disassemble, or attempt to derive el source code of el App; and (iv) make el functionality of el App available to multiple users through any means. el foregoing privilege grant is not a Oferta of el Apps or any copy elreof, and Molekule and/or its third-party partners or suppliers retain all right, title, and interest in el Apps (and any copy elreof). Molekule reserves all rights in and to el App not expressly granted to you under estos Terms. 
 
Rights in Site Content Granted by Molekule 
Subject to your compliance with estos Terms, Molekule grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable, privilege to download, view and print el Site content solely in connection with your permitted use of el Services and solely for your personal and non-commercial purposes. This privilege terminates automatically if you breach any of el Terms.  Upon termination you must immediately destroy any downloaded, printed, and copied materials.
 
Mobile App Compatibility and Updates 
To use el Apps on a mobile device, you must have a mobile device que is compatible con el Apps. You are solely responsible for determining if your mobile device is compatible con el Apps. Molekule does not warrant que el Apps will be compatible con your mobile device. You may use mobile data, text, and calling services, in connection with el Apps, which use may cause you to incur additional charges from your mobile carrier for those services. You agree que you are solely responsible for all such charges.  
 
Molekule may from time-to-time issue version updates of el Apps. Such updates will automatically install on your mobile device if you have previously agreed en tu mobile operating system settings to automatic updates with respect to el Apps. else updates may include security, vulnerability, auelntication, performance, functionality, and/or bug fixes, or App enhancements, and may be issued with or without prior notification to you. Any failure to update el App may result in el App ceasing to operate on your device. All updates to el Apps are subject to estos Terms. Any third-party code que may be incorporated in el Apps is covered by el applicable open source or third-party license EULA, if any, authorizing use of such code.  
 
Product Software Updates 
Molekule may from time-to-time cause automatic downloads of software updates to be automatically installed on your Product. else software updates may include security, vulnerability, auelntication, performance, functionality, and/or bug fixes, or enhancements, and may be issued with or without prior notification to you. usando our Products, you are consenting to such automatic software downloads and updates to el Products. If you do not agree to such downloads and updates, eln you may not be able to use el Apps and Web Services in conjunction with el Products. Such automatic downloads and updates only occur for Services connected to el internet. All carrier, internet, or oelr related connection and/or use charges, in connection with or arising out of your use of el Services are your sole responsibility. 
 
Multiple Products with la misma serial number, filter serial number, or unique identifier, are prohibited from being used in connection with eielr el Apps, Web Services, or el Products. Molekule reserves el right to render el Services (incluyendo your Product) INOPERABLE que are used, or attempted to be used, in conjunction with such prohibited artículos. 

General Prohibitions

  • Modify, adapt, translate, or create derivative works based on, el Services;
  • Gain or attempt to gain unauthorized access to el Services or any network traffic and communications relating elreto;
  • Alter, circumvent, intercept, copy, download, disable, or reassign any key, restriction, unique identifier, or tag auelntication data, related to el Services, incluyendo, but limited to, enabling or attempting to enable you, or anyone in privity with you or your purchased Filters to use such data, in whole or in part, on non-genuine filtros for Molekule purifier Products or oelrwise attempt to oelrwise defeat any Filter restrictions, incluyendo, but not limited to, using el filtro’s original auelntication or security data in, on, or in connection with, non-genuine filtros for Molekule Products;
  • Use el Services in any manner or for any purpose if you are a competitor with respect to el Products or Apps;
  • Use el Services in any manner or for any purpose to conduct security or vulnerability scans, assessments, probes, or penetration tests;
  • Use el Services in any manner or for any purpose que infringes, misappropriates or oelrwise violates any intellectual property right or oelr right of any third party or que violates any applicable law with respect to such third party;
  • Restrict or inhibit any oelr user of el Services from using or enjoying el Services;
  • Interfere with or disrupt el integrity, operation, or performance of el Services or interfere with el use or enjoyment of it by oelrs, incluyendo, but not limited to, bypassing, breaching, cloning, eavesdropping, sniffing, descrambling, or hijacking any security or auelntication protocol, technology, measure, or protection used for or contained in el Services (incluyendo any third party services que are used in conjunction with el Services);
  • Attempt to probe, scan, overburden, or test el vulnerability of, any Molekule systems, communications, or networks;  
  • Using any automated program, tool, or process (incluyendo, without limitation, web crawlers, robots, bots, spiders, and automated scripts) to access el Services or any server, network or system associated with this Services, or to extract, collect, observe, capture, track, harvest or gaelr content or information from el Services;
  • Creating (or attempting to create) multiple accounts in connection with el Services (incluyendo using proxy IP addresses or falsified/fake identities to hide el use of multiple accounts) for el purpose of disrupting, misusing, or obtaining unauthorized access to el Services, or disrupting, misusing, or obtaining unauthorized access to el communications, data, and/or network traffic of oelr users of el Services;
  • Use el Services to encourage, promote, facilitate, or instruct oelrs to engage in illegal activity;
  • Use el Services in any way to harass, threaten, abuse, stalk, deceive, falsify, mislead, or commit fraud;
  • Use any meta tags or oelr hidden text or metadata utilizing a Molekule trademark, logo, URL or Product name, without Molekule’s express prior written consent;
  • Use el Services to violate any applicable law, rule, or regulation; and/or
  • Encourage, assist, aid, or enable any oelr individual, organization, or entity to do any of el foregoing.

Links to Third Party Websites or Resources 
el Services, incluyendo el Site, may contain links to third-party websites or resources. We provide estos links only as a convenience and on an “AS IS” and “AS AVAILABLE” basis, and are not responsible for elir content, products, or services on, or available from, those websites, resources, or links displayed on such websites. You are solely responsible for, and assume all risk arising from, your use of any third-party websites or resources. 
 
Third-Party Sponsored Programaaas Accessible Through el Site or App 
From time to time el Site or App may make accessible to you third-party sponsored offerings and programs for rental subscription services for use in connection with Molekule Products (an “Authorized Third Party Programaaa”). Authorized Third Party Programaaas are not subject to estos Terms, and are governed by el terms and conditions of el Authorized Third Party Programaaa provider/sponsor. Although Molekule’s Products may be used in el Authorized Third Party Programaaa, Molekule does not warrant, endorse, guarantee, or assume responsibility for any product, service, or subscription service, advertised, offered, or provided in, by, or through, such third-party offering or program, incluyendo but not limited to any Authorized Third Party Programaaa. All products, services, and subscription services, provided in, by, or through any Authorized Third Party Programaaa are not covered by any Molekule garantía or refund policy.

Subject to el Limited Garantía Conditions (defined below), Molekule provides a limited garantía for a period of one (1) year from, as applicable, eielr (i) el Mo Humidificador Glow shipment date to you by us (subject to el shipment being verified by our records based upon your correo electrónico address used for el applicable Product purchase) or (ii) to el extent el Mo Humidificador Glow was sold to you through a Molekule authorized third party retailer or reseller (see https://molekule.com/pages/authorized-molekule-resellers), your purchase date from such  authorized retailer/reseller subject to you providing us valid proof of purchase, (el “New Mo Glow Product Limited Garantía Term”), que your new Mo Humidificador Glow Product will, under normal use and care, and any oelr additional requirements as may be included in el documentation provided with such Product, be free from defects in materials and workmanship (el “New Mo Glow Product Limited Garantía”).    
 
Molekule’s Limited Garantía Conditions  
Each of Molekule’s New Product Limited Garantía, New Mo Glow Product Limited Garantía, and Refurbished Product Limited Garantía are subject to el following conditions (colectivamente, el “Limited Garantía Conditions”): (i) el garantía claim is for genuine Molekule Products; (ii) el garantía claim is not attributable to normal wear and tear of el Product; (iii) el garantía claim is for defects in materials or workmanship while el Product was operated in accordance with el User Manual and/or Quick Start Guide provided with eielr el Product or Refurbished Product, or online; (iv) el garantía claim is not attributable, to el extent applicable, el filtro being replaced outside of Molekule’s recommended time frames (see https://help.molekule.com); (v) el garantía claim is for Product que has only been used with el original power cord  supplied; (vi) el garantía claim is not attributable to tampering, mishandling, neglect, negligence, accidents, electrical disturbance, lightning, abnormal voltage, fire, liquid spills, water, transportation, modification, abuse, animal interactions, el use of non-Molekule third party filtros, and/or oelr Product misuses; (vii) el garantía claim is for Product que has not had its original factory serial number eliminard, defaced, altered, or reused; (viii) el garantía claim is not attributable to commercial and/or non-household use, rental use, or any oelr use for which el Product is not intended; (ix) el garantía claim is not attributable to  any subscription service, advertised or offered, by a third party through el Site or App, any hyperlinked website, or any website or mobile application featured in any banner, or oelr advertising on el Site or App; (x) el garantía claim is not attributable to any product, service, or subscription service offered or provided by or through an Authorized Third Party Programaaa; (xi) el garantía claim is not attributable to el Product being used in areas subject to extreme temperature (below 33ºF, above 113 ºF), excessive moisture (above 75% relative humidity), and/ or oelr inherently hazardous environments; (xii) el garantía claim is not for corrosion, rust or oelr deterioration due to environmental factors; (xiii) el garantía claim is not for incidental or consequential damages; and (xiv) el garantía claim is not for damages or defects exceeding el cost of el Product paid purchase price; 
 
eligibility Period for Molekule’s Filter Limited Garantía 
Subject to el filtro Limited Garantía Conditions (defined below), Molekule provides a limited garantía for a period of thirty (30) days (el “Filter Garantía Term”) commencing on (i) el filtro shipment date to you by us (subject to your Filter shipment being verified by our records based upon your correo electrónico address used for el filtro purchase), or (ii) your Filter purchase date from an authorized (see below link) third-party retailer or reseller (subject to you providing us valid proof of purchase), que your new Filter will, under normal use and care, and any oelr additional requirements as may be included in el documentation provided with el Product, be free from defects in materials and workmanship (el “Filter Limited Garantía”).  
 
Conditions To Molekule’s Filter Limited Garantía 
Molekule’s Filter Limited Garantía is subject to el following conditions (colectivamente, el “Filter Limited Garantía Conditions”): (i) el garantía claim is for a genuine Molekule Filter; (ii) el garantía claim is not attributable to normal wear and tear del filtro; (iii) el filtro was used in accordance with el User Manual and/or Quick Start Guide provided with eielr el applicable purifier Product or Refurbished Product, or online at el Site; (iv) el garantía claim is not attributable to tampering, mishandling, neglect, negligence, accidents, electrical disturbance, lightning, fire, transportation, liquid spills, water, modification, abuse, animal interactions, or misuse del filtro in  conjunction with el purifier Product; (v) el filtro has not had its original NFC tag auelntication data or information defaced, altered, written over, copied, or oelrwise reused or compromised; (vi) el filtro was not used in areas subject to extreme temperature (below 32ºF, above 113ºF) or oelr inherently hazardous environments; (vii) el garantía claim is not attributable to commercial use, rental use, or any oelr use for which el filtro is not intended;  (viii) el garantía claim is not attributable to  any subscription service, advertised or offered, by a third party through el Site or App, any hyperlinked website, or any website or mobile application featured in any banner, or oelr advertising on el Site or App; and (ix) el filtro was only used during operation with el applicable recommended purifier Product.  
 
Molekule’s Obligations Under Its Limited Warranties 
el nuevo Product Limited Garantía, Refurbished Product Limited Garantía, New Mo Glow Product Limited Garantía, and Filter Limited Garantía (individually and colectivamente el “Limited Warranties”) are only applicable to genuine Molekule Products, and are, at Molekule’s sole option, limited to eielr Molekule’s repair or replacement of el warrantied Product to el extent determined by Molekule to be covered under el Limited Warranties, and elreafter el repaired or replaced Product will be only be warranted for el greater of (i) que period of time, if any, remaining under el original Product/Filter limited garantía term (as applicable), or (ii) thirty (30) calendar days from el return shipment date by us to you. Dispute Notice and Informal Dispute Resolution  
If a dispute should arise between you and Molekule we want to provide you with a resolution que is efficient and cost effective. Governing Law and Venue for Actions 
else Terms and any action related elreto will be governed by el laws of el State of Florida without regard to its conflict of laws provisions. el exclusive jurisdiction and venue of any action, claim, or demand, relating to el Services will be in el state and federal courts located in el Palm Beach County, West Palm Beach, Florida and each of el parties hereto (Molekule, and you and your transferees) waives any objection to jurisdiction and venue in such courts. 
 
Dispute Resolution Changes 
Notwithstanding el provisions describing changes to estos Terms above, if Molekule changes this “Dispute Resolution” section, you may reject any such change by sending us written notice by correo electrónico to [email protected], or by mail at Molekule Group, Inc., Attn: Legal Department, 10455 Riverside Drive, Suite 100, Palm Beach Gardens, FL 33410 within thirty (30) days of el date such change became effective, as indicated in el “Última Actualización” date above or, if applicable, in el date of Molekule’s correo electrónico to you notifying you of such change. For notices made by e-mail, el date of sending will be deemed el date on which such notice is transmitted. For modification of el Terms, el effective date of such modification shall be el date when such Terms are posted to el Site. 
 
Molekule’s failure to enforce any right or provision of estos Terms will not be considered a waiver of such right or provision. el waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Molekule. Except as expressly set forth in estos Terms, el exercise by eielr party of any of its remedies under estos Terms will be without prejudice to its oelr remedies under estos Terms or oelrwise.
