When you first sign up and create an account on www.molekule.com (el “Site Account”) you: (i) are automatically enrolled in el Loyalty Programaaa, (ii) are assigned a Loyalty Programaaa account (a “Loyalty Account”), and (iii) have agreed to be bound by all of el Loyalty Programaaa’s Loyalty Terms. If you no longer want to participate in el Loyalty Programaaa, or do not agree with el Loyalty Terms, you are required to contact customer soporte at (855) 999-9069 or [email protected] to terminate your membership in el Loyalty Programaaa.  You are bound by el Loyalty Terms until you have terminated your membership in el Loyalty Programaaa in accordance with estos Loyalty Terms.  

Molekule, in its sole discretion, may terminate el Loyalty Programaaa, in whole or in part, with forty-five (45) days advance correo electrónico notice to all active Members (using el correo electrónico address en tu Site Account at time of such notice), or as oelrwise permitted by applicable law. At Molekule’s sole discretion, we may choose to substitute anoelr loyalty program for el Loyalty Programaaa at any time immediately upon correo electrónico notice to active Members. Except as oelrwise expressly prohibited or limited by applicable law, Molekule may, at any time, amend, supplement, change or modify, in its sole and absolute discretion, any aspects of el Loyalty Programaaa, with or without notice, even though such actions may affect el value of Points or Rewards, el structure for earning Points or redeeming Rewards, or el ability to obtain certain Points or Rewards. Members are responsible for remaining knowledgeable of, and keeping up to date with, el Loyalty Terms, incluyendo any changes, revisions, or modifications to elm as are posted de vez en cuando on el Site. Your continued participation in el Loyalty Programaaa will constitute your acceptance of all such Loyalty Programaaa changes and modifications.

IF YOU DO NOT AGREE TO ALL OF el LOYALTY TERMS, incluyendo el TERMS AND PRIVACY NOTICE INCORPORATED elREIN BY REFERENCE, DO NOT PARTICIPATE IN el LOYALTY PROGRAM. 

1. Introducción 

el Loyalty Programaaa allows eligible Site visitors to enroll and participate in el Loyalty Programaaa by creating a Loyalty Account at www.molekule.com. Through el Loyalty Programaaa, subject to el Loyalty Terms, you are provided el opportunity to earn points (“Points”) by participating in various activities and/or purchases of producto Molekules, some of which are described below. Members, on an “AS IS” and “AS AVAILABLE” basis, can redeem elir Points de vez en cuando for various Rewards. el Loyalty Terms govern el Loyalty Programaaa along with any oelr terms or policies incorporated elrein by reference into estos Loyalty Terms such as el Terms and el Aviso de Privacidad. el Loyalty Programaaa is provided to individuals only. Membership in el Loyalty Programaaa is free and available to any individual who: (i) is a legal resident of one of el fifty (50) Estados Unidos or el District of Columbia, (ii) is eighteen (18) years of age or older and possesses el legal authority to agree to el Loyalty Terms, (iii) creates a Site Account; (iv) provides valid and accurate personal information when creating elir Site Account; (v) has not had elir access to el Site terminated or suspended; and (vi) has not been terminated previously from el Loyalty Programaaa.  

Once you properly complete and submit all information required to open your Site Account, you are automatically enrolled in el Loyalty Programaaa and assigned a Loyalty Account. All information requested to obtain a Site Account must be completed in full and be true and correct. el Loyalty Programaaa is only for your own personal use. Molekule reserves el right to request materials to verify your identity in connection with your use of el Site Account and/or Loyalty Account. You should not give your Site Account contraseña to any oelr person. You are responsible for all activity en tu Site Account and any use of your contraseña in connection elrewith.  

Members may not use el Loyalty Programaaa for commercial purposes, or in any way que harms Molekule or any oelr person or entity, as determined by Molekule in its sole discretion. A Member Loyalty Account can only be used by el Member whose name is listed on el Loyalty Account. If you attempt to obtain more than one Loyalty Account, all Points en tu Loyalty Account(s) may be forfeited, and Molekule may, in its sole discretion, terminate your Member status in el Loyalty Programaaa.  

Officers, directors and employees of Molekule and its subsidiaries, (each, a “Programaaa Entity”, and colectivamente, el “Programaaa Entities”) may participate in el Loyalty Programaaa but may not be allowed to redeem Points for certain Rewards and may oelrwise be subject to restrictions que do not generally apply to how Points are earned or used by non-Programaaa Entity Members. Corporations, associations, or oelr groups may not participate in el Loyalty Programaaa. It will be considered fraudulent for any individual, company, club, association, or group to use or to direct, encourage, or allow oelr persons to use a single Loyalty Account for el purpose of accumulating or aggregating Points for combined use.  

Participation in el Loyalty Programaaa constitutes each Member’s permission for Molekule to use el Member’s first name, photograph, likeness, voice, general biographical information, statements, address (city and state only) and a descripción of any Rewards won, for advertising and/or publicity purposes worldwide, and in all forms of media now known or hereafter developed, in perpetuity, without furelr compensation. 

 

 

3. Deactivate or Delete Loyalty Account. 

You can withdraw from el Loyalty Programaaa and deactivate your Loyalty Account by submitting a request to 855-999-9069 or [email protected]. If you request to withdraw from el Loyalty Programaaa, you will permanently lose any Points and Rewards que your Loyalty Account had accumulated. Such Points and Rewards will not be restored if you later sign up for a Loyalty Account. 

4. Unsubscribe from Correo electrónicos/Texts. 

el easiest way to opt out of marketing from Molekule is by following el instructions on el messages you receive from us.  A text message may indicate, for example, que you may reply STOP to halt furelr marketing messages, while an correo electrónico may include a link to click to “UNSUBSCRIBE.” 

5. Membership Tiers.  

Upon opening your Loyalty Account, Molekule will, in its sole determination, assign you a membership tier status of Bronze, Silver, or Gold (each, a “Membership Tier”).  elreafter, your Loyalty Programaaa status membership in el Bronze and Silver tiers will be determined based on el number of Points que such Member receives in elir Loyalty Account during el preceding twelve meses (el “Rewards Year”) as determined by Molekule. Members will only be assigned to el Gold tier if ely participate in an automatic recurring subscription for Molekule filtros.  

Details regarding el Membership Tiers and how el Rewards Year is calculated are available at molekule.com/pages/inner-circle. Once a Member reaches a certain Membership Tier status, el Member will retain que status for twelve meses. After twelve meses have passed, el Member will eielr remain at la misma tier or move down to a different tier according to el number of points received or oelr qualifications. At any time in el Rewards Year, if el Member receives enough Points or oelrwise qualifies to move up a Membership Tier, eln que change will automatically take place at que time. Points from one Rewards Year do not roll over to a subsequent Rewards Year for purposes of determining Membership Tier. Molekule reserves el right to change, modify, or update el number of Points or oelr actions and requirements needed to earn each Membership Tier status and benefits. 

6. Earning Points. 

Members have many ways to earn Points in el Loyalty Programaaa (“eligible Programaaa Activities”), which can be redeemed for Rewards. eligible Programaaa Activities are defined in el following ways below (subject to change). For details related to number of Points associated with eligible Programaaa Activities for each Membership Tier, please visit molekule.com/pages/inner-circle

  • Signing Up for a Loyalty Account. Members can earn Points by opening a Site Account and automatically becoming a Member of el Loyalty Programaaa via molekule.com/pages/inner-circle or by agreeing to become a Member when making certain qualifying purchases. 
  • Making Purchases on el Site.  Members can earn Points by purchasing producto Molekules via el Site. el Members will receive Points for each U.S. dollar spent on el Site (pre-taxes and fees, after applicable discounts, and rounded to el nearest dollar). el number of Points earned per dollar spent is contingent upon each Member’s Membership Tier. You cannot earn points on orders placed through third-party resellers or retailers, such as Amazon, Walmart, or Target. Molekule may choose to offer limited time promotions during which some purchases will be eligible for “Bonus Points.” All Points are automatically added for eligible purchases, or deducted for eligible returns, to a Member’s Loyalty Account. 
  • Referrals. el Loyalty Programaaa may provide you, as a Member, with el opportunity to earn Points for referring your friends to purchase qualifying producto Molekules from us and your referred friend elreafter uses your referral discount code/link to make a qualifying Molekule purchase (“Referral Points”). Referrals can be made in a number of different ways (see https://molekule.com/pages/inner-circle ). Referral Points will be issued to your Loyalty Account only once per qualifying referral. 
  • Birthday Points. el Loyalty Programaaa may provide Members with el opportunity to earn Points at or around elir birthday of record if ely choose to enter que information in elir Loyalty Account (“Birthday Points”). To receive Birthday Points, Molekule may require you to have been a Member for a certain amount of time prior to your birthday of record and/or Conoce certain minimum purchase or Points requirements. 
  • Opt-in to Promotional Communications. el Loyalty Programaaa may provide Members with el opportunity to earn Points in exchange for signing up to receive promotional and marketing offers from Molekule. 
  • Social Media Activity. el Loyalty Programaaa may provide Members with el opportunity to earn Points by following Molekule accounts on social media, incluyendo Instagram and Facebook. 
  • Posting Reviews. el Loyalty Programaaa may provide Members with el opportunity toearn points by posting reviews on el Site. Any review posted to earn points must include el hashtag “#MolekuleloyaltyProgramaaaReview.” Reviews que include a photo are eligible for additional Points. 

Molekule reserves el right, in its sole discretion, to determine and modify, at any time, el value of Points and el number of Points, or el type of Reward, que may be earned for any given Loyalty Programaaa activity. 

7. Points and Rewards Redemption and Restrictions. 

Members may redeem Points for rewards as determined by Molekule in its sole discretion (each, a “Reward”). Available Rewards include future discounts on producto Molekules purchased on el Site. el Rewards, Point redemption values, and Points per dollar spend, are posted on el Site at https://molekule.com/pages/inner-circle  and are subject to change in Molekule’s sole discretion at any time without prior notice. 

Points are normally posted to your Loyalty Account within fifteen (15) days from your corresponding eligible Programaaa Activities. When redeeming Points from your Loyalty Account for a Reward, Molekule will first redeem el oldest Points en tu Loyalty Account (meaning first Points earned que are en tu account at el time of el Reward redemption) and eln redeem, as applicable, el Points en tu account que were earned elreafter, until el Reward redemption amount has been satisfied. Please note que your Loyalty Account Points will expire within 18 meses of first earning elm (from el date of your corresponding eligible Programaaa Activity). For example, if a Member’s eligible Programaaa Activities (e.g., hace a purchase) occur on January 1, eln que Member’s Points earned from que activity will expire on July 1 of el following year if ely are not earlier used, wheelr in whole or in part, for a Reward redemption.  

el expiration date for your use of a redeemed Reward, if any, will be discerrard when el Reward is presented and may vary for different categories of Rewards. You may view your current earned Points and redeemed unused Rewards by logging into your Loyalty Account. Molekule, in its sole discretion, may impose a limit on el number of Points or Rewards in el aggregate or by type que may be earned or redeemed per Loyalty Account, per day, per Reward, or per any oelr generally-applicable metric que may be selected by Molekule de vez en cuando in its sole discretion. Points are not accrued on any Reward redemption.  

Molekule reserves el right, at any time, to modify, amend, or revise, in its sole discretion, (i) el Rewards available, (ii) el number of Points required to redeem any Reward may be substantially increased, (iii) withdraw any Reward, and (iv) impose restrictions and oelr terms and conditions associated with any Reward or its redemption. Rewards are non-assignable and non-transferable. Any Rewards assigned or transferred in violation of estos Loyalty Terms may be confiscated or canceled.  

Members shall be solely responsible for all federal, state, and/or local taxes incluyendo, without limitation, income taxes and any reporting consequences elreof in connection with a Reward. If required by law, as determined by Molekule in its sole discretion, Molekule reserves el right to withhold and remit to el appropriate taxing authorities el amount of any taxes due. 

Points and Rewards have no cash value and may not be redeemed for cash and may not be sold, auctioned, bartered, brokered, purchased, transferred, assigned, or used to engage in any gambling activity. Any Points or Rewards obtained in this manner by any person or entity will be considered to have been fraudulently obtained and deemed void and such Points and Rewards may be confiscated or cancelled by Molekule in its sole discretion. Points and Rewards must be redeemed in accordance with estos Loyalty Terms, in effect at el time of such redemption. Points and Rewards will not be replaced, reissued, or credited if lost, stolen, or oelrwise altered or destroyed.  

Once you have redeemed your Points for a Reward, your Points are eliminard from your Loyalty Account and your Point redemption Reward transaction is final, and cannot elreafter be cancelled, reversed, or refunded, for any reason. Even if you return el products, merchandise, or oelr artículo(s) que you received using your Reward, no Points or Rewards will be credited back to your Loyalty Account. 

8. Modification and Termination. 

Además to as provided elsewhere in estos Loyalty Terms, and without limiting such oelr provisions: 

Molekule may modify any of estos Loyalty Terms, incluyendo, but not limited to, el methods through which Points or Rewards can be earned, how Points or Rewards can be used, el types of Points available, el Membership Tiers, and el conditions under which Points or Rewards may expire or be forfeited, at any time, with or without notice, even though estos changes may affect a Member's ability to use el Points or Rewards que el Member has already earned. el Loyalty Programaaa has no predetermined termination date and may continue until such time que Molekule decides to terminate el Loyalty Programaaa.  

If Molekule amends estos Loyalty Terms, it will revise el “last updated” date located at el top of estos Loyalty Terms. Members may not rely on continued Points or Reward availability. Molekule hace no representation or garantía about el number or type of Rewards que may be available after Loyalty Programaaa termination has been announced, and many Rewards que may have been available prior to termination may quickly become depleted or oelrwise unavailable once el Loyalty Programaaa termination has been announced. Any Points or Rewards remaining in a Member's Loyalty Account at el time of Loyalty Programaaa termination will be forfeited and no compensation will be provided.  

Molekule may cancel your membership in el Loyalty Programaaa, cancel accumulated Points or Rewards, alter el number of Points or Rewards en tu Loyalty Account, or suspend your Loyalty Programaaa membership privileges at any time with immediate effect if Molekule determines in its sole discretion que you have: (a) acted in a manner inconsistent with applicable laws or ordinances; (b) acted in a fraudulent or abusive manner; (c) breached any of estos Loyalty Terms; (d) engaged in any fraud or abuse concerning Points or Rewards, Points/Rewards usage or Points/Rewards redemption; (e) acting in an unethical or disruptive manner; (f) acting with intent to annoy, abuse, threaten or harass Molekule, its representatives, or any oelr Member in any manner related to el Loyalty Programaaa; or (f) engaged in any conduct or act que causes Molekule to terminate or suspend your access to your Loyalty Account. Molekule may also take appropriate administrative or legal action if any of el artículos listed above occurs. Nothing contained in estos Loyalty Terms shall limit Molekule in its exercise of any legal or equitable rights or remedies it may have against you, except as oelrwise provided in Section 12 or in el Terms. 

9. electronic Communications. 

When you visit el Site or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically, incluyendo targeted correo electrónicos, surveys, promotional offers, and for oelr general business purposes. We will communicate with you by e-mail or by posting notices on el Site. You agree que all agreements, notices, disclosures, and oelr communications que we provide to you electronically satisfy any legal requirement que such communications be in writing. You furelr agree que any notices provided by us electronically are deemed to be given and received on el date we transmit any such electronic communication as described in estos Loyalty Terms. We reserve el right to send you correo electrónicos for administrative purposes even if you opt out of marketing communications. If you consented to receive SMS messages sent to your mobile phone, eln you will receive marketing and transactional messages sent via auto dialer. You are not required to consent to receive estos messages to receive el goods and services associated with el Loyalty Programaaa. Mensaje and data rates may apply to your receipt of estos SMS messages. You may opt out of receiving SMS messages or correo electrónicos at any time. 

 

10. General Términos y Condiciones. 

ACCRUED POINTS AND REWARDS DO NOT CONSTITUTE PROPERTY OF A MEMBER AND HAVE NO VALUE OUTSIDE OF el LOYALTY PROGRAM. POINTS AND REWARDS ARE CREDITS que MOLEKULE MAY REVOKE AT ANY TIME AS SET FORTH HEREIN. POINTS AND REWARDS ARE NOT TRANSFERABLE UPON DEATH, AS PART OF A DOMESTIC RelATIONS MATTER, OR OelRWISE.  

If a Member cree que el Member’s Loyalty Account does not properly reflect Points or Rewards earned from engaging in any activities, el Member must contact Molekule to resolve el issue. Any attempt by any person to undermine el legitimate operation of el Loyalty Programaaa may be a violation of criminal and civil law. Should such an attempt be made by you, Molekule reserves el right to seek damages from you to el fullest extent permitted by law.  

Molekule’s failure to enforce any of estos Loyalty Terms shall not constitute a waiver of el affected provision, or any oelr provision. All questions or disputes regarding an individual’s eligibility for el Loyalty Programaaa, el earning, crediting or use of Points or Rewards, or a Member’s compliance with estos Loyalty Terms will be resolved by Molekule in its sole discretion. 

11. Loyalty Programaaa Malfunctions and Conduct. 

Además to as provided elsewhere in estos Loyalty Terms, and without limiting such oelr provisions: 

el Programaaa Entities are not responsible for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites, or oelr connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, or difficulties, or oelr errors of any kind or nature; or for el incorrect or inaccurate capture of information, or el failure to capture any information. Additionally, el Programaaa Entities are not responsible or liable for any computer, programming, printer errors or el issuance of any unintended Points or Rewards. In no event will Programaaa Entities be liable for, and Members expressly release el Programaaa Entities from any claims as to el issuance of any unintended Points or Rewards.  

In el event Molekule is prevented from continuing with el Loyalty Programaaa by any event beyond its control (each a “Force Majeure” event or occurrence), incluyendo but not limited to: (i) fire, flood, earthquake, windstorm, epidemic, pandemic, public health crisis, disease, virus, sickness or outbreak or oelr similar or dissimilar natural disaster; (ii) act of God or public enemy; (ii) riot or civil disturbance, act of any government or governmental authority, power failure, satellite or equipment failure, failure of telecommunications lines or failure or breakdown of plant, machinery or vehicles operated by a third party; (iii) labor dispute, strike, or lockout; (iv) actual or threat of war, armed conflict, terrorist attacks, war (declared, undeclared or threatened), explosion, nuclear, or chemical or biological contamination; (v) or a government imposed travel ban, restriction on movement or gaelrings, or oelr government imposed mandate of any kind, order of any court or jurisdiction, or oelr cause not reasonably within Molekule’s control, Molekule shall have el right to modify, suspend, or terminate el Loyalty Programaaa, in whole or in part, in its sole discretion. 

12. Dispute Resolution and Class Action Waiver. 

You and Molekule agree que all disputes pertaining to el Loyalty Programaaa or estos Loyalty Terms will be resolved pursuant to el dispute resolution provisions provided for in el Terms and que such Terms shall govern and control in el event of a conflict or ambiguity with estos Loyalty Terms.  

YOU AND MOLEKULE AGREE que EACH MAY BRING CLAIMS AGAINST el OelR FOR DISPUTES PERTAINING TO el LOYALTY PROGRAM OR elSE LOYALTY TERMS ONLY en tu OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. 

YOU AND MOLEKULE HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE, TO el FULLEST EXTENT PERMITTED BY LAW, ANY AND ALL RIGHTS EACH OF elM MAY HAVE (incluyendo BUT NOT LIMITED TO, elIR CONSTITUTIONAL OR STATUTORY RIGHT) TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING FOR ANY DISPUTE, incluyendo BUT NOT LIMITED TO DISPUTES ARISING OUT OF, FROM, OR RelATING TO elSE LOYALTY TERMS OR el RelATIONSHIP OF SUCH PARTIES. 

13. Privacy. 

Unless oelrwise indicated in estos Loyalty Terms, by participating in el Loyalty Programaaa, Members agree que Molekule will use el personal information collected about elm in connection with el Loyalty Programaaa as set forth in Molekule’s Aviso de Privacidad. 

14. Severability. 

If any provision of estos Loyalty Terms is held invalid or unenforceable by a court of competent jurisdiction, que provision will be enforced to el maximum extent permissible and el oelr provisions of estos Terms will remain in full force and effect.

1. Introducción

Through el Loyalty Programaaa, subject to el Loyalty Terms, you are provided el opportunity to earn points (“Points”) by participating in various activities and/or purchases of producto Molekules, some of which are described below. All information requested to obtain a Site Account must be completed in full and be true and correct. el Loyalty Programaaa is only for your own personal use. Molekule reserves el right to request materials to verify your identity in connection with your use of el Site Account and/or Loyalty Account. Participation in el Loyalty Programaaa constitutes each Member’s permission for Molekule to use el Member’s first name, photograph, likeness, voice, general biographical information, statements, address (city and state only) and a descripción of any Rewards won, for advertising and/or publicity purposes worldwide, and in all forms of media now known or hereafter developed, in perpetuity, without furelr compensation. 

 

 

3. Deactivate or Delete Loyalty Account. 

You can withdraw from el Loyalty Programaaa and deactivate your Loyalty Account by submitting a request to 855-999-9069 or [email protected]. If you request to withdraw from el Loyalty Programaaa, you will permanently lose any Points and Rewards que your Loyalty Account had accumulated. Such Points and Rewards will not be restored if you later sign up for a Loyalty Account. 

4. Unsubscribe from Correo electrónicos/Texts.

5. Membership Tiers.  

Upon opening your Loyalty Account, Molekule will, in its sole determination, assign you a membership tier status of Bronze, Silver, or Gold (each, a “Membership Tier”).  elreafter, your Loyalty Programaaa status membership in el Bronze and Silver tiers will be determined based on el number of Points que such Member receives in elir Loyalty Account during el preceding twelve meses (el “Rewards Year”) as determined by Molekule. Members will only be assigned to el Gold tier if ely participate in an automatic recurring subscription for Molekule filtros.  

Details regarding el Membership Tiers and how el Rewards Year is calculated are available at molekule.com/pages/inner-circle. Once a Member reaches a certain Membership Tier status, el Member will retain que status for twelve meses. 6. Earning Points. 

Members have many ways to earn Points in el Loyalty Programaaa (“eligible Programaaa Activities”), which can be redeemed for Rewards. eligible Programaaa Activities are defined in el following ways below (subject to change). For details related to number of Points associated with eligible Programaaa Activities for each Membership Tier, please visit molekule.com/pages/inner-circle

  • Signing Up for a Loyalty Account. Members can earn Points by opening a Site Account and automatically becoming a Member of el Loyalty Programaaa via molekule.com/pages/inner-circle or by agreeing to become a Member when making certain qualifying purchases. 
  • Making Purchases on el Site.  Members can earn Points by purchasing producto Molekules via el Site. el Members will receive Points for each U.S. dollar spent on el Site (pre-taxes and fees, after applicable discounts, and rounded to el nearest dollar). el number of Points earned per dollar spent is contingent upon each Member’s Membership Tier. You cannot earn points on orders placed through third-party resellers or retailers, such as Amazon, Walmart, or Target. Molekule may choose to offer limited time promotions during which some purchases will be eligible for “Bonus Points.” All Points are automatically added for eligible purchases, or deducted for eligible returns, to a Member’s Loyalty Account. 
  • Referrals. el Loyalty Programaaa may provide you, as a Member, with el opportunity to earn Points for referring your friends to purchase qualifying producto Molekules from us and your referred friend elreafter uses your referral discount code/link to make a qualifying Molekule purchase (“Referral Points”). Referrals can be made in a number of different ways (see https://molekule.com/pages/inner-circle ). Referral Points will be issued to your Loyalty Account only once per qualifying referral. 
  • Birthday Points. el Loyalty Programaaa may provide Members with el opportunity to earn Points at or around elir birthday of record if ely choose to enter que information in elir Loyalty Account (“Birthday Points”). To receive Birthday Points, Molekule may require you to have been a Member for a certain amount of time prior to your birthday of record and/or Conoce certain minimum purchase or Points requirements. 
  • Opt-in to Promotional Communications. el Loyalty Programaaa may provide Members with el opportunity to earn Points in exchange for signing up to receive promotional and marketing offers from Molekule. 
  • Social Media Activity. el Loyalty Programaaa may provide Members with el opportunity to earn Points by following Molekule accounts on social media, incluyendo Instagram and Facebook. 
  • Posting Reviews. el Loyalty Programaaa may provide Members with el opportunity toearn points by posting reviews on el Site. Any review posted to earn points must include el hashtag “#MolekuleloyaltyProgramaaaReview.” Reviews que include a photo are eligible for additional Points. 

Molekule reserves el right, in its sole discretion, to determine and modify, at any time, el value of Points and el number of Points, or el type of Reward, que may be earned for any given Loyalty Programaaa activity. 

7. Points and Rewards Redemption and Restrictions. 

Members may redeem Points for rewards as determined by Molekule in its sole discretion (each, a “Reward”). Available Rewards include future discounts on producto Molekules purchased on el Site. el Rewards, Point redemption values, and Points per dollar spend, are posted on el Site at https://molekule.com/pages/inner-circle  and are subject to change in Molekule’s sole discretion at any time without prior notice. 

Points are normally posted to your Loyalty Account within fifteen (15) days from your corresponding eligible Programaaa Activities. When redeeming Points from your Loyalty Account for a Reward, Molekule will first redeem el oldest Points en tu Loyalty Account (meaning first Points earned que are en tu account at el time of el Reward redemption) and eln redeem, as applicable, el Points en tu account que were earned elreafter, until el Reward redemption amount has been satisfied. Members shall be solely responsible for all federal, state, and/or local taxes incluyendo, without limitation, income taxes and any reporting consequences elreof in connection with a Reward. If required by law, as determined by Molekule in its sole discretion, Molekule reserves el right to withhold and remit to el appropriate taxing authorities el amount of any taxes due. 

Points and Rewards have no cash value and may not be redeemed for cash and may not be sold, auctioned, bartered, brokered, purchased, transferred, assigned, or used to engage in any gambling activity. Any Points or Rewards obtained in this manner by any person or entity will be considered to have been fraudulently obtained and deemed void and such Points and Rewards may be confiscated or cancelled by Molekule in its sole discretion. Points and Rewards must be redeemed in accordance with estos Loyalty Terms, in effect at el time of such redemption. Points and Rewards will not be replaced, reissued, or credited if lost, stolen, or oelrwise altered or destroyed.  

Once you have redeemed your Points for a Reward, your Points are eliminard from your Loyalty Account and your Point redemption Reward transaction is final, and cannot elreafter be cancelled, reversed, or refunded, for any reason. Even if you return el products, merchandise, or oelr artículo(s) que you received using your Reward, no Points or Rewards will be credited back to your Loyalty Account. 

8. Modification and Termination.

Molekule may cancel your membership in el Loyalty Programaaa, cancel accumulated Points or Rewards, alter el number of Points or Rewards en tu Loyalty Account, or suspend your Loyalty Programaaa membership privileges at any time with immediate effect if Molekule determines in its sole discretion que you have: (a) acted in a manner inconsistent with applicable laws or ordinances; (b) acted in a fraudulent or abusive manner; (c) breached any of estos Loyalty Terms; (d) engaged in any fraud or abuse concerning Points or Rewards, Points/Rewards usage or Points/Rewards redemption; (e) acting in an unethical or disruptive manner; (f) acting with intent to annoy, abuse, threaten or harass Molekule, its representatives, or any oelr Member in any manner related to el Loyalty Programaaa; or (f) engaged in any conduct or act que causes Molekule to terminate or suspend your access to your Loyalty Account. Molekule may also take appropriate administrative or legal action if any of el artículos listed above occurs. ACCRUED POINTS AND REWARDS DO NOT CONSTITUTE PROPERTY OF A MEMBER AND HAVE NO VALUE OUTSIDE OF el LOYALTY PROGRAM. POINTS AND REWARDS ARE CREDITS que MOLEKULE MAY REVOKE AT ANY TIME AS SET FORTH HEREIN. POINTS AND REWARDS ARE NOT TRANSFERABLE UPON DEATH, AS PART OF A DOMESTIC RelATIONS MATTER, OR OelRWISE.  

If a Member cree que el Member’s Loyalty Account does not properly reflect Points or Rewards earned from engaging in any activities, el Member must contact Molekule to resolve el issue. Any attempt by any person to undermine el legitimate operation of el Loyalty Programaaa may be a violation of criminal and civil law. Should such an attempt be made by you, Molekule reserves el right to seek damages from you to el fullest extent permitted by law.  

Molekule’s failure to enforce any of estos Loyalty Terms shall not constitute a waiver of el affected provision, or any oelr provision. All questions or disputes regarding an individual’s eligibility for el Loyalty Programaaa, el earning, crediting or use of Points or Rewards, or a Member’s compliance with estos Loyalty Terms will be resolved by Molekule in its sole discretion. 

11. Loyalty Programaaa Malfunctions and Conduct. 

Además to as provided elsewhere in estos Loyalty Terms, and without limiting such oelr provisions: 

el Programaaa Entities are not responsible for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites, or oelr connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, or difficulties, or oelr errors of any kind or nature; or for el incorrect or inaccurate capture of information, or el failure to capture any information. Additionally, el Programaaa Entities are not responsible or liable for any computer, programming, printer errors or el issuance of any unintended Points or Rewards. In no event will Programaaa Entities be liable for, and Members expressly release el Programaaa Entities from any claims as to el issuance of any unintended Points or Rewards.  

In el event Molekule is prevented from continuing with el Loyalty Programaaa by any event beyond its control (each a “Force Majeure” event or occurrence), incluyendo but not limited to: (i) fire, flood, earthquake, windstorm, epidemic, pandemic, public health crisis, disease, virus, sickness or outbreak or oelr similar or dissimilar natural disaster; (ii) act of God or public enemy; (ii) riot or civil disturbance, act of any government or governmental authority, power failure, satellite or equipment failure, failure of telecommunications lines or failure or breakdown of plant, machinery or vehicles operated by a third party; (iii) labor dispute, strike, or lockout; (iv) actual or threat of war, armed conflict, terrorist attacks, war (declared, undeclared or threatened), explosion, nuclear, or chemical or biological contamination; (v) or a government imposed travel ban, restriction on movement or gaelrings, or oelr government imposed mandate of any kind, order of any court or jurisdiction, or oelr cause not reasonably within Molekule’s control, Molekule shall have el right to modify, suspend, or terminate el Loyalty Programaaa, in whole or in part, in its sole discretion. 

12. Dispute Resolution and Class Action Waiver. 

You and Molekule agree que all disputes pertaining to el Loyalty Programaaa or estos Loyalty Terms will be resolved pursuant to el dispute resolution provisions provided for in el Terms and que such Terms shall govern and control in el event of a conflict or ambiguity with estos Loyalty Terms.  

YOU AND MOLEKULE AGREE que EACH MAY BRING CLAIMS AGAINST el OelR FOR DISPUTES PERTAINING TO el LOYALTY PROGRAM OR elSE LOYALTY TERMS ONLY en tu OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. 

YOU AND MOLEKULE HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE, TO el FULLEST EXTENT PERMITTED BY LAW, ANY AND ALL RIGHTS EACH OF elM MAY HAVE (incluyendo BUT NOT LIMITED TO, elIR CONSTITUTIONAL OR STATUTORY RIGHT) TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING FOR ANY DISPUTE, incluyendo BUT NOT LIMITED TO DISPUTES ARISING OUT OF, FROM, OR RelATING TO elSE LOYALTY TERMS OR el RelATIONSHIP OF SUCH PARTIES. 

13. Privacy. 

Unless oelrwise indicated in estos Loyalty Terms, by participating in el Loyalty Programaaa, Members agree que Molekule will use el personal information collected about elm in connection with el Loyalty Programaaa as set forth in Molekule’s Aviso de Privacidad. 

14. Severability. 

If any provision of estos Loyalty Terms is held invalid or unenforceable by a court of competent jurisdiction, que provision will be enforced to el maximum extent permissible and el oelr provisions of estos Terms will remain in full force and effect.
